A party wall is a wall shared by two properties, for instance the walls which divide properties between terraced houses. The Party Wall etc. Act 1996 was introduced to provide the framework for preventing and resolving disputes in relation to party walls, as well as boundary walls and excavations near neighbouring buildings. If you intend to carry out building work which falls within the Party Wall etc. Act 1996, it is essential that you notify all affected neighbours by issuing a Party Wall Notice. If you have received a notification, then you must respond correctly to avoid prejudicing your position. Work which is typically covered by the Party Wall etc. Act 1996 includes:
- Work on an existing wall or structure shared with another property
- Building a free standing wall or a wall of a building up to or astride the boundary with a neighbouring property
- Excavating near a neighbouring building
- Extensions
- Damp proofing works
- Structural alterations
